The writ petition has been taken up through video conferencing. It is accompanied with an application for urgency which on consideration is allowed.
Heard learned counsel for petitioner, learned State Counsel for opposite parties 2 to 4 while notices on behalf of opposite party No.1 has been accepted by Mr. Rohit Tripathi learned counsel.
Writ petition has been filed seeking following reliefs:-
" (i) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to implement the order dated 28.11.2015 passed by District Magistrate/District Election officer, Gonda in appeal no.37 under rule 21(A) Registration of Electors Rules 1994, before the District Magistrate/District Election Officer, Gonda (opp. party no.2), Ajay Singh & others Vs State of U.P. through District Magistrate Gonda and in appeal no.38 under rule 21 (A) Registration of Electors Rules, 1994, before the District Magistrate/District Election officer, Gonda (opp.party no.2), Dinesh Pratap Singh & others Vs State of UP through District Magistrate Gonda in the interest of justice.
(ii) Issue a wit, order or direction in the nature of Mandamus commanding the opp. party no.2 to decide the representation dated 31.03.2021, contained as Annexure no.6 to this writ petition, as early as possible, in the interest of justice."
Learned counsel for petitioner submits that despite the necessary orders having been passed vide order dated 28th November, 2015 in appeal No. 37 filed by the petitioner, the same is not being implemented for which purpose the petitioner has already made a representation dated 31st March, 2021 which is still pending consideration.
Considering the prayer made in the petition and the fact that the petitioner has already submitted a representation to the authority concerned, the writ petition is disposed of with a direction to the opposite party No.2 to decide the representation of the petitioner dated 31st March, 2021expeditiously, within a period of six weeks, if possible from the date a copy of this order is produced before the said authority.
