Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P, Sri Manu Srivastava, Advocate holding brief of Sri Manish Tiwary, learned counsel for the informant and perused the material available on record.
Supplementary affidavit has been filed on behalf of the applicant wherein it has been mentioned that the transaction in between the informant and the applicant has been well settled and no dispute exists for the time being, copy of the compromise deed has been annexed as annexure SA-1 to the affidavit filed in support of the supplementary affidavit. The applicant is languishing in jail since 10.04.2018.
At this stage, a query was raised to the learned counsel for the informant whether he opposes the prayer for bail, whereupon he nodded in negative and submitted that he has no objection, if the bail application is allowed.
Learned A.G.A. has not disputed the aforesaid facts.
Without entering into merit of the case but considering the facts and circumstances of the case that the parties have settled their own dispute and no useful purpose will be served by detaining the applicant in jail, the applicant is entitled to be released on bail. Accordingly, bail application is allowed.
Let the applicant Manish Kumar Pandey involved in Case Crime No.160 of 2018, under Sections 419, 420, 408 I.P.C., Police Station Civil Lines, District Allahabad be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
