JUDGMENT / ORDER

Petitioner has approached this Court complaining about the inaction on the part of the 3rd respondent in not considering his complaint Exts. P2 and P3. The complaint came to be filed with reference to Ext. P1 audit report in relation to the working of the 5th respondent club, which is a society registered under the Travancore Cochin Literary Scientific and Charitable Societies Registration Act, 1955 (for short 'the Act'). 2. Counter affidavit is filed by the 3rd respondent inter alia stating that there is no obligation on the part of the District Registrar to conduct an enquiry as requested by the petitioner. It is further stated that the District Registrar considered the complaint and records and formed an opinion that there was no factual or legal basis to conduct such enquiry.
3. Learned counsel for respondents 4 and 5 seeks time to file counter affidavit . Having regard to the nature of contentions urged, I do not think that any further time is to be granted for filing counter affidavit by respondents 4 and 5.
4. Though the 3rd respondent had stated in the counter affidavit that they had conducted proper enquiries W.P(C) No. 12357 of 2013 -: 2 :-
in the matter, no documents are forthcoming intimating the petitioner about the outcome of the enquiry with reference to Exts. P2 and P3. It is the case of the petitioner that the 3rd respondent is bound to conduct enquiry under Section 33 of the Act. In the above circumstances, this writ petition is disposed of as under:
The 3rd respondent is directed to inform the petitioner about the outcome of Exts. P2 and P3 and if necessary after appropriate enquiry.
