JUDGMENT / ORDER

These writ petitions have been filed by the petitioners praying for a writ of mandamus to direct the respondents to issue the individual mark sheets, consolidated mark sheets and the provisional certificates, relating to the Registration No.42302106011(Manish Kishore) , 42302106021(Surej salim kumar), respectively, to the petitioners.
2.Learned counsel appearing on behalf of the respondents would submit that an enquiry committee has been constituted to enquire into the matter of alleged tampering of the university records, during the November- December, 2007, examinations of the E.C.E. Course, conducted by the first respondent.
3.Learned counsel for the respondents had placed before this court the instructions issued by the controller of examinations in letter No.COE/MP/2009, dated 23.06.2009, which reads as follows:
"In continuation of this office letter cited under Reference 2, I wish to submit the following recommendation of the enquiry committee constituted to enquire the students including Mr.Manish Kishore (Reg.No.42302106011) and Mr.Suraj Salim Kumar (Reg.No.42302106021) and the staff alleged to have been involved in tampering of the university records during the November/December 2007 examinations:
"1.The committee recommends to consider the original marks obtained by the students as per their original answer scripts and results may be processed accordingly.
2. The committee also recommends
(i) to issue Statement of Marks to all the candidates with the original marks secured by them in November 2007 examinations and in the subsequent appearances.
(ii) to issue provisional/Degree certificates to all the students alleged to have been involved, if they are eligible to get the same as and when they qualify for the degree.
3. Further the committee recommends that if any material evidence is later made available to show the involvement of the students, the University may take action against the students and cancel the results declared, the Statement of Marks, Provisional/Degree certificates issued to the students. In this regard an undertaking may be obtained from the students(before issuing the Provisional/Degree Certificates) to the effect to surrender the same."
4. In view of the submissions made by the learned counsel appearing on behalf of the respondents 1 and 2, this court is of the view that no further orders are necessary in these Writ Petitions. However, it is made clear that it would be open to the petitioners to approach the first respondent to obtain the records and certificates required by them.
With the above observation, this writ petition stands closed. Consequently, connected M.P's are closed.
