Issue notice to respondent no. 3 By means of the present writ petition, the petitioners have sought for quashing the FIR dated 10.12.2009, registered as case crime no. 18 of 2009, under Sections 498-A, 323, 504 313 IPC and 3/4 D.P. Act, P.S. Mahila Thana Baghpat District- Baghpat.
It is matrimonial dispute and Court is of the opinion that an effort be made to reconcile between the parties.
We, therefore, direct the petitioners to deposit sum of Rs. 10000/- with the Mediation Centre, Allahabad within two weeks. Upon such deposit, the Mediation Centre shall issue notice to the respondent no. 3 to appear before it on specified date and if she appears, the amount of Rs. 5000/- be paid to the respondent no. 3 towards expenses incurred. The arrest of the petitioners, namely Manish Giri @ Daini, Subhash Giri and Smt. Pammi shall remain stayed initially for a period of two weeks and if the petitioners deposit Rs. 10000/- as directed above, the arrest shall remain stayed till the Mediation Centre submits its report.
The writ petition be listed after the Mediation centre submits the report.
