Petitioner was employed as Health Worker (Woman) at Community Health Centre, Jalalabad, Shahjahanpur. The petitioner attained the age of superannuation on 30.06.2015. Her grievance is that though substantial period has expired since her retirement, but pension has been been sanctioned to her. It is stated that 90% GPF amount, however, has been paid to the petitioner in September, 2016. This petition has been filed for a direction upon the respondent to ensure release of petitioner's withheld retiral dues, including pension, etc.
Learned standing counsel submits that grievance of the petitioner shall be examined by the authority concerned, in accordance with law.
In the facts and circumstances of the case, noticed above, this petition stands disposed of with a direction upon respondent no. 2 to accord consideration to the petitioner's claim for release of pension and other retiral benefits within a period of two months from the date of presentation of certified copy of this order. The amount, which is due and payable to the petitioner, shall be released within a further period of two months, thereafter.
In case the retiral dues are not released, in terms of the aforesaid direction, petitioner shall be entitled to get interest @ 8% per annum. It shall be open for the authorities to recover the amount of interest, after determining the guilt of the officer concerned, who is responsible for not ensuring the release of such amount. It is also made clear that in case the petitioner's retiral amount are withheld for any specific lawful reason, the petitioner shall be informed of the reasons, in that regard, within a period of four weeks from the date of production of certified copy of this order.
