We have heard learned counsel for the petitioners and learned AGA for the State.
An FIR dated 7.7.2017 is registered under Section 376 IPC and 3/4 of the Dowry Prohibition Act, PS Shahpur, District Gorakhpur.
Learned counsel for the petitioners has drawn our attention to the statement of the victim recorded under Section 164 Cr.P.C. filed as Annexure-2 to this Writ Petition. The petitioners' statement indicates that it is on account of demand of dowry by the petitioners' side that the marriage is presently installed, otherwise there is no objection to both the parties.
We feel that it is appropriate to call both the parties and have their respective statements and also, if possible, get the matter resolved amicably.
We accordingly direct this matter to be placed before the Court on
8.3.2018.
On the said date, the petitioner No.1 and respondent No.3 along with the victim, Km. Sunita Chauhan, to remain present before the Court.
Counsel for the petitioner has assured that he would make sure that petitioner No.1 would be present on the next date and so far as the respondent No.3 along with her daughter are concerned, the concerned Investigating Officer will escort them to remain present before this Court.
A copy of this order be provided to Shri Gaurav Pratap Singh, learned Brief Holder, within 24 hours for necessary compliance.
Till then the petitioners may not be arrested in Case Crime No. 316 of 2017, Police Station Shahpur, District Gorakhpur.
If on the next date fixed, the petitioner No.1 does not appear before the Court, this petition will stand dismissed, without any further arguments.
