Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant has contended that the applicant was challaned under the Gangster Act showing five cases in the gang chant out of which in three cases, the applicant was challaned on the same day showing police encounter. In all the cases, applicant is already on bail. Applicant is in jail since 22.10.2009. There is no chances of misuse of liberty of bail if the applicant is granted bail.
In view of the aforesaid fact without expressing any opinion on merit, let the applicant Manish @ Banti be released on bail, in Case Crime No. 666 of 2009 under Section 2/3 U.P. Gangster Act, P.S. Nauchandi, District Meerut on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
