1. Heard learned counsel for the petitioner as well as learned Standing Counsel for the State respondents while Sri Bhupendra Kumar Tripathi has accepted notice for respondent No.14-Gaon Sabha.
2. In view of the order proposed to be passed, requirement of issuance of notice to respondent nos.2 to 13, is hereby dispensed with.
3. Instant petition has been filed by the petitioner praying for direction to Deputy District Magistrate, Jakhaniya District Ghazipur to expedite the proceedings for measurement and demarcation to the Tehsildar/Revenue Inspector Mangla and others Vs. Harish Chandra and others under Section 24(1) of U.P. Revenue Code, expeditiously. Learned counsel for the petitioner submits that grievance of the petition would be sufficiently met in case aforesaid case is considered and decided in the time bound manner.
4. Learned Standing Counsel has no objection to the aforesaid prayer.
5. Considering the facts and circumstances of the case, without entering into the merits, Deputy District Magistrate, Jakhaniya District Ghazipur, is directed to decide to expedite the proceedings for measurement and demarcation to the Tehsildar/Revenue Inspector Mangla and others Vs. Harish Chandra and others under Section 24(1) of U.P. Revenue Code, expeditiously, say within a period of three months from the date of production of a copy of this order, in accordance with law, if there is no legal impediment.
6. It is further directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances.
7. With above observations/directions, the writ petition stands disposed of.
