Heard Sri Haridwar Singh, learned counsel for the petitioner and learned Standing Counsel for respondents State. Sri R.P. Shukla, learned counsel has accepted notice on behalf of Gaon Sabha.
It is contended that a suit under Section 176 of the U.P.Z.A. and L.R. Act was filed on 16.07.2014 before respondent no. 2, which is pending consideration. The sole prayer is for early disposal of the proceedings.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 2 to decide the Suit No. T- 201406022326 (Mangaru vs. Satiram), under Section 176 of U.P.Z.A. and L.R. Act, if there are no legal impediments and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of one year from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
