In response to the order dated 10.01.2018, the instructions sent by District Inspector of Schools, Ballia dated 29.03.2018 produced by learned Standing Counsel is taken on record.
As per instructions it reveals that an amount of Rs. 9,23,894/- has already been sanctioned and token has also bee issued. An amount of Rs. 48,626/- has been deducted towards income tax.
Sri J.P.N. Singh, learned counsel for the petitioner submits that the District Inspector of Schools, Ballia has still not released the entire amount as per order dated 07.02.2018, passed by Director of Secondary Education, Uttar Pradesh.
The Court is of the considered opinion in the facts and circumstances of the case that substantial compliance has been done, however, it is open to the petitioner that in case, there is some deficient amount, he would be at liberty to move fresh representation before the concerned District Inspector of Schools. In case, if any such representation is made within ten days from today along with certified copy of this order, this Court hopes and trust that the same shall be strictly dealt with by the concerned in accordance with law.
With the aforesaid observation, the writ petition is disposed of.
