JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Heard learned Advocate MR. J. M. Buddhbhatti for the appellants, who are convicted by the learned Additional Sessions Judge, City Sessions Court, Ahmedabad in Sessions Case No.410 of 2009 by Judgment and Order dated 27.04.2012. The learned Additional Sessions Judge was pleased to convict the appellants guilty for the offences punishable under sections 8(c), 20(b)(ii)(c) read with section 29 of the NDPS Act and sentenced them for ten years Rigorous Imprisonment and fine of Rs. One lac and in default of payment of fine, the accused shall undergo a further Rigorous Imprisonment for a period of six months.
Learned Advocate for the appellants invited the attention of this Court to the discussion of evidence in the matter and submitted that the learned Additional Sessions Judge has committed an error in convicting the accused for the aforesaid offence, more particularly when there is no evidence against them.
The matter requires consideration.
