RESPONDENT (BY:SRI M.I.ARUN, ADVOCATE ) THIS CIVIL MISCELLANEOUS PETITION IS FILED UNDER SECTION 11(6) OF THE ARBITRATION AND CONCILIATION ACT, 1996, PRAYING TO APPOINT AN ARBITRATOR FOR ADJUDICATING THE DISPUTE BETWEEN THE PETITIONER AND THE RESPONDENT THAT HAS ARISEN PURSUANT TO THE CONCESSION AGREEMENT DATED 23.3.2005 AND ETC.
THIS C.M.P. COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R This petition is filed seeking the appointment of the Arbitrator under Section 11(6) of the Arbitration and Conciliation Act, 1996.
2. The parties herein have entered into the Concession Agreement, dated 23.3.2005. Clause 10.2 of the said agreement provides for the dispute resolution through the mechanism of arbitration. The dispute has arisen in relation to the said agreement.
3. On hearing both the learned advocates, I allow this petition. I appoint Sri A.C.Vidyadhara, a retired District Judge as the sole arbitrator. He is requested to enter upon the reference, arbitrate the dispute and conduct the arbitration proceedings at the Arbitration and Conciliation Centre, Bengaluru (Domestic and International), as per the Arbitration and Conciliation Centre Rules, 2012.
4. Registry is directed to send a copy of this order to the Arbitration Centre, Bengaluru, forthwith.
