ORDER Sri K. Shashi Kiran Shetty, learned senior counsel for Sri Kiran J., learned counsel for the petitioners.
Sri V. Shivareddy, learned High Court Government Pleader for respondent Nos.1 to 3 and 6.
The petition is admitted for hearing. With the consent of the parties, it is heard finally.
2. In this petition, the petitioner inter alia assailing the validity of the notification dated 19.07.2016, issued by respondent No.3 by which applications for the appointment of the members of the committee of management for Mangaldi Mutt (Sri Mangala mahalakshmi Mutt, Palli) are invited. A Bench of this Court by an order dated 17.11.2015, struck down the Act in its entirety and declared it as discriminatory and violative of rights.
3. Therefore, notification issued by respondent No.3 dated 19.07.2016 cannot be given effect. The notification dated 19.07.2016, is hereby quashed with liberty to the petitioners to take recourse to such remedy as may be available in law, in case the grievance of the petitioners still subsists.
4. It is made clear that this Court has not expressed any opinion on the merits of the case.
5. Accordingly, the writ petitions are disposed of with liberty as aforesaid.
