Jayamma W/o Late Kariyayya, Aged about 50 years, All the above petitioners are the Resident of Kundanahally Village, Kasaba Hobli, Krishnarajapet Taluk, Mandya District-571 426. …Petitioners (By Sri. Dhananjaya V.S., Advocate) AND:
1. The Assistant Executive Engineer Kaveri Neeravari Nigama Ltd., No.4, H.L.B.C Sub-Division, Kikkeri, Kikkeri Village and Hobli, Krishnarajapet Taluk, Mandya District-571 426.
2. The Special Land Acquisition Officer Deputy Commissioner Office, 1st Floor, Hassan, Hassan District-573 201.
3. Deputy Commissioner Mandya District, Mandya-571 401. …Respondents (By Sri. E.S. Indiresh, AGA) These Writ Petitions are filed under Article 226 of the Constitution of India, praying to issue directions to the R-1 to submit the proposals to the R-2 for the payment of all kinds of compensations to the petitioners in respect of their lands, crops, horticultural trees and other damages form the date of taking possession of the lands in which without notifications the lands acquired and possession was taken as per Annexures-B and E and etc.
These Writ Petitions coming on for Preliminary Hearing this day, the Court made the following:
O R D E R Learned Additional Government Advocate accepts notice for the respondents.
2. Learned counsel for the parties submit ad- idem that in identical circumstances, the Cognate Bench of this Court has directed the respondent to take a decision on the petitioners grievance stated in his representations and pass a speaking order inasmuch as the entitlement of petitioner to the compensation as sought for and accordingly, seeks for disposal of these writ petitions in similar terms.
3. The submission is placed on record.
4. This Court is convinced that the petitioners herein being similarly situated as that of petitioners in W.P. Nos.28054-28065/2019 disposed of on 28.08.2019, they are entitled to the similar relief.
5. Respondent Nos.1 and 3 shall consider the representations submitted at Annexures-‘B’ series and E and take a decision in accordance with law by passing a speaking order and the same shall be communicated to the petitioners at the earliest.
The compliance shall be made within a period of eight weeks from the date of receipt of certified copy of this order.
Accordingly, writ petitions stand disposed of.
