JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) WEDNESDAY, THE ELEVENTH DAY OF JUNE TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.7513 of 2012 BETWEEN Mangalagiri Lovaraju.
AND ... PETITIONER The Tahsildar, Golugonda Mandal, Visakhapatnam and another.
...RESPONDENTS Counsel for the Petitioner: MR. C.S. SURYA PRAKASH RAO Counsel for the Respondents: GP FOR REVENUE The Court made the following:
ORDER:
Petitioner states that he is the owner and possessor of Ac.8.71 cents in Sy.No.51/1 and 51/2 and also owner of an extent of Ac.6.77 cents in Sy.No.52/2 at Galugonda Mandal, Narasipatnam Sub-Registry, Visakhapatnam. Petitioner further states that survey was conducted with respect to the aforesaid land by the Mandal Surveyor. Petitioner now seeks that the said survey supports the petitioner’s contention that he is the owner and possessor. Petitioner filed the present writ petition alleging that the official respondents are not issuing pattadar passbooks and title deeds.
2. The averments in the affidavit, however, show that the petitioner has not applied in the prescribed proforma and has not paid any fees, as required under the A.P. Rights in Land and Pattadar Passbooks Act (for short ‘the Act’). In that view of the matter, consideration of the case of the petitioner for grant of pattadar passbooks and title deeds, at this stage, would not arise.
Petitioner, however, is at liberty to make an appropriate application as per Form-VI under Rule 18 of the Rules framed under the Act by complying with the said requirement and if any such application is made by the petitioner, the Tahsildar, first respondent shall consider the said application and pass appropriate orders within a period of three (3) months from the date of receipt of such application.
The writ petition is accordingly disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
