A fresh report of the Chief Judicial Magistrate, Banda dated 20.09.2018 is on record indicating that sole appellant Mangal Singh had expired thirty years ago. In this regard, the enquiry was conducted as per circular of this Court. In view of the death of sole appellant, the appeal has lost its efficacy. Accordingly appeal stands abated.
Let the order be communicated along with the lower court record to the Chief Judicial Magistrate, Banda for necessary compliance.
