Heard learned counsel for the petitioner and Shri Ramesh Chandra Upadhyay for the Gaon Sabha, respondent no.3.
This writ petition has been filed seeking the following relief -
(i) issue a writ, order or direction in the nature of mandamus directing to the respondent no.2 to make paimaish of the chak prepared chak map and give delivery of possession to the petitioner upon chak allotted to him at the stage of Deputy Director of Consolidation as provided section 28 of Uttar Pradesh Consolidation of Holdings Act, 1953.
In fact, the petitioner seeks implementation of an order dated 22.11.2014 passed in Revision No.238 (Udaibhan and others Vs. Gaon Sabha).
In case, an order passed by the Consolidation authorities has not implement on the spot, the remedy is by means of an application under Rule 109A of the U.P. Consolidation of Holding Rules. This remedy has not been availed by the petitioner.
In case, the petitioner is so advised, he may file a proper application under Rule 109A of the U.P. Consolidation of Holding Rules for the requisite relief.
Subject to the above, this writ petition stands disposed of.
