JUDGMENT / ORDER

An order refusing to set aside the ex-parte decree after condoning the delay in a suit for specific performance is under challenge. The order is very much appealable under Order XLIII Rule 1(d) of the Code of Civil Procedure wherein the grounds relating to condonation of delay can also be urged.
2. The Civil Revision Petition filed under Section 115 of the Code of Civil Procedure is misconceived therefore and is accordingly dismissed. This will be without prejudice to the right of the petitioner to file a Civil Miscellaneous Appeal if so advised.
