JUDGMENT / ORDER

1. Heard Mr. Pujara, learned advocate for the petitioners, Mr. Raval, learned AGP for respondent No.1 and 2 and Mr. Mishra, learned advocate for respondent No.3.
2. Mr. Mishra, learned advocate has filed affidavit dated 9.4.2012 on record explaining reasons related to the time consumed in making final orders which are impugned in the petitions. The said affidavit also deals with the claim of the petitioners who, according to the respondents, were not eligible and / or whose names were not included in the select list.
3. It is however noticed that though much reliance is placed on the select list prepared at the relevant time, as per which the appointment orders were to be issued, the said select list is, as of now, not available on record. Reliance has also been placed by the respondents on the decision to operate the said select list up to Serial No.614. The said decision / order / resolution is also not available on record but the said aspect is asserted in the affidavit. It is submitted by Mr. Mishra, learned advocate for the respondent No.3 that a typed copy of the said select list will be placed on record and the original select list will be kept ready at the time of hearing of petitions for perusal by learned advocate for the petitioners. It would be open to the learned advocate for the petitioners to examine the said documents at the time of hearing or by making appropriate application to the learned advocate for the respondent.
4. Having regard to the facts and circumstances of the case Rule returnable on 1.5.2012. Mr. Janak Raval, learned AGP waives service of Notice of Rule on behalf of respondent Nos. 1 and 2 and Mr. R.A. Mishra, learned advocate waives service of Notice of Rule on behalf of respondent No.3.
5. It is not in dispute that the orders passed by the petitioners have been duly served and even implemented and as of today the petitioners are not in service. Therefore at this stage question of granting any interim relief does not arise. Therefore, subject to the aforesaid directions interim relief cannot be and is not granted.
