By this petition, the petitioner seeks a direction in the nature of mandamus commanding the respondent no. 1- Consolidation Commissioner, U.P., Lucknow to consider and decide the application dated 10.5.2017 moved by the petitioner alongwith other villagers for closing of the consolidation operations by issuing the notification under section 6 of the U.P. Consolidation of Holdings Act, 1953 (hereinafter referred to as the Act), within a stipulated period of time.
Contention of the learned counsel for petitioner is that due to geographical reasons, continuation of consolidation operation is not in the interest of the villagers and even the land of the village does not come within the meaning of "holdings" as defined under the Act. It is further submitted that the application was filed by petitioner on 10.5.2017 but no decision has been taken thereon as yet though one year has already elapsed.
In the facts and circumstances of the case, a direction is issued upon respondent no. 1- Consolidation Commissioner, U.P., Lucknow to consider and decide the application dated 10.5.2017 moved by the petitioner alongwith other villagers appended as annexure- 2 to the writ petition, in accordance with law expeditiously within six months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
