JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Pandya, learned APP waives service of rule on behalf of respondent-State.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to take care of the agricultural work.
It appears from the jail report that convict was released on 2 times in the year 2011 on temporary bail. It appears from the application made by him that he has one son who is doing labour work.
Under the circumstances, the ground is not such where his presence can be said as indispensable.
Therefore, the discretion does not deserve to be exercised. Hence, the application is not granted. Rule discharged.
