Learned counsel for the petitioner submits that the present writ petition may be dismissed as withdrawn subject to availing alternate remedy of recalling the ex-parte order dated 10.08.2018 passed by learned Principal Judge, Family Court, Mahoba in case no. 05/2018, under Section 125 Cr.P.C., P.S. Ajnar, District Mahoba.
Accordingly, the instant writ petition is dismissed as withdrawn with liberty to the petitioner to move an appropriate application before the concerned court for recalling the ex-parte order dated 10.08.2018 and in case, such an application is filed, the same shall be heard and decided by the court concerned in accordance with law.
