Heard learned counsel for the parties.
The petitioners were awarded construction work by Nagar Palika Parishad Chitrakoot Dham, Karvi, Disytrict Chitrakoot. The petitioners allege that they have completed the same, even then the payment has not been released to them.
The matter as to whether the petitioners have completed the contract in a satisfactory manner or as to the amount which is payable to them are all matters of fact which cannot be adjudicated in exercise of writ jurisdiction.
Accordingly, we dispose of the writ petition with liberty to the petitioners to approach the respondent no. 4, Executive Officer, Nagar Palika Parishd Chitrakoot Dham Karvi, District Chitrakoot, about their above grievance within a period of two months from today. In case, any such representation is filed, the respondent no. 4, Executive Officer, Nagar Palika Parishad, Chitrakoot Dham Karvi, shall consider and decide the matter in accordance with law most expeditiously, if possible, within a period of six weeks thereafter. In the event respondent no. 4 comes to the conclusion that the petitioners are entitled any payment, the same shall be paid to them forthwith within a period of two weeks, thereafter.
With the above observation, the writ petition is disposed of.
