Heard learned counsel for the parties.
Petitioner by the instant writ petition seeks the following relief:
"Issue a writ in the name of mandamus directing the respondents to consider the seniority of the petitioner for the purpose of pension and retirement with effect from their joining and decide the representation dated 22.09.2020 (Annexed as Annexure No. 5 to the writ petition) in terms of the government order dated 20.2.1992 bearing it reference as later no. 1721 and it revisional settlement dated 27.12.1996/02.08.1995 and the order dated 28.12.2019 passed in writ petition no. 32825 of 2019, after giving full opportunity of hearing of the petitioners."
Learned Standing Counsel at the out set submits that the petitioner herein is a workcharge employee claiming pensionary benefits upon computation of the period of service rendered as workcharge employee prior to regularization. He further submits that the State Government promulgated Ordinance dated 21 October 2020 amending the Service Rules retrospectively depriving all such workcharge employees from pensionary benefits.
Learned counsel for the petitioner submits that the petition may be dismissed as withdrawn with liberty to the petitioner to file a fresh petition raising challenge to the Ordinance.
The writ petition is, accordingly, dismissed as withdrawn with the aforesaid liberty.
