By this petition, the petitioner seeks a writ in the nature of mandamus commanding the respondent no. 1-Deputy Director of Consolidation, Agra to decide stay application dated 18.4.2018 moved by the petitioners in Revision No. 211 of 2018, Mahendra Singh and others Vs. Rohtan Singh and others, within a reasonable period of time.
Contention of the learned counsel for petitioner is that against the order dated 16.4.2018 passed by the Settlement Officer Consolidation, the petitioners filed a revision before the Deputy Director of Consolidation alongwith an application for interim order. The said application is pending and no order has been passed thereon till date. It is further contended that the contesting respondents are negotiating to transfer the land in question.
In the facts and circumstances of the case, a direction is issued upon respondent no. 1-Deputy Director of Consolidation, Agra to dispose of stay application dated 18.4.2018 pending in Revision No. 211 of 2018, Mahendra Singh and others Vs. Rohtan Singh and others, in accordance with law expeditiously within three months from the date of production of a certified copy of this order. For a period of three months or till decision of the stay application, parties are directed not to create third party interest on the property in dispute.
With the above directions, the writ petition stands finally disposed of. No order as to costs.
