Heard learned counsel for the petitioner; the learned Standing Counsel for the State-respondents 1 and 2; and perused the record.
It appears that a marital dispute between the petitioner and the respondent no.3 is engaging attention of the Principal Judge, Family Court at Ghazipur.
In this petition, a prayer has been made to command the Chief Medical Officer to carry out sexual potency test of the petitioner as well as of the respondent no.3 through a Medical Board.
Such a prayer can appropriately be addressed by the Court where the litigation is pending between petitioner and the respondent no.3.
Under the circumstances, this petition is dismissed without prejudice to the right of the petitioner to apply to the court concerned where the proceedings are pending.
