Even though in compliance of the order dated 25.10.2018 passed by another Bench of this Court, corpus Mamta has been produced before this Court by S.I. Vipin Kumar, L.C. Shikha, H.C. Rakesh Kumar, P.S. Deoria Kalan District Pilibhit, but apparently the corpus does not appear to be major. The writ petition also does not disclose anything with regard to age of the corpus and thus, in view of the aforesaid circumstances this Court finds it difficult to grant any indulgence to the corpus. Thus, for want of better particulars the writ petition is misconceived and is being dismissed at this stage.
However, at this stage learned counsel for the petitioners submits that he would like to withdraw the present writ petition with liberty to seek appropriate remedy before appropriate forum.
Learned counsel for the complainant Sri Ajay Kumar Sharma submits that against the order of Magistrate a revision has been filed and the same is pending consideration before this Court.
In view of the observations made above and in view of the request made by learned counsel for the petitioners, the writ petition is dismissed as withdrawn.
Corpus Mamta produced in custody from Women Shelter Home Bareilly will now be taken back to the said Shelter Home by the constables who have brought her this Court and she will acknowledge the custody.
