By means of the present petition, the petitioner is seeking quashing of the first information report dated 06.08.2021 registered as Case Crime No.415 of 2021, under Sections 408, 384, 506 I.P.C., P.S.- Seohara, District- Bijnor.
It is contended that the present first information report, quashing of which has been sought, is a counter blast to the first information report lodged by the petitioner on 12.12.2020.
Disputing the said submission, it is stated by the learned counsel for the respondent that a complaint had been lodged before the Senior Superintendent of Police on 02.12.2020 and an application under Section 156(3) Cr.P.C. was filed on 07.12.2020. The petitioner infact had lodged the first information report after getting information of filing of application under Section 156(3) Cr.P.C.
Be that as it may, from a perusal of the allegations in the first information report, it cannot be said that it does not make out commission of the cognizable offence. It is not possible for the Court to ascertain the merits or demerits of the allegations therein. Any interference at this stage may impede the speedy investigation.
The writ petition is, thus, found devoid of merit and, hence, dismissed.
