Heard Sri Manvendra Singh, learned counsel for the applicant, learned A.G.A., and perused material on record.
The present application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the Civil Judge (Senior Division)/ Additional Chief Judicial Magistrate, Fatehpur to decide the F.R. No. 13300 of 2018 (Mamta Vs. Ram Vishal), in Case Crime No. 108 of 2018, under Sections 376-D & 504 of Indian Penal Code, registered registered at Police Station Hathgaon, District Fatehpur, expeditiously within stipulated period.
Learned counsel for the applicant submits that the first information report has been lodged against Ram Vishal and two unknown persons, under Sections 376-D and 506 of I.P.C., in which Investigating Officer has submitted Final Report (Closure Report) without proper investigation. Being aggrieved with the action of local police, the applicant has filed protest petition on 13.03.2019, which is pending before the aforesaid court as yet.
Considering the fact that the trial has remained pending since 2019 without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, within a period of two months without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
With the aforesaid directions, the application stands disposed of finally.
Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
