1. This intra-Court Appeal under Chapter VIII Rule 5 of Allahabad High Court Rules, 1952 has arisen from judgment and order dated 13.04.2012 passed by learned Single Judge dismissing appellant's Writ Petition No. 18606 of 2012 (Mamta verma vs. State of U.P. and others).
2. The appellant-petitioner has challenged the Government Order issued by State with respect to age limit for admission in BTC Course, 2010 on the ground it is contrary to U.P. Basic Education (Teachers) Service Rules, 1981 (hereinafter referred to as "Rules 1981").
3. Rules, 1981 are applicable for recruitment and appointment of Assistant Teachers in Primary Schools, maintained by U.P. Basic Education Board (hereinafter referred to as "Board"), while Government Order in question prescribes conditions for admission in B.T.C. Course, 2018, which is a training qualification and admission to the said course, per se, does not mean recruitment or appointment as Assistant Teacher. With respect to qualification for Teachers' Training, Rules, 1981 are applicable. Government Order containing terms and conditions for eligibility to admission in Teachers Training Course has nothing to do with Rules, 1981. Hence, we find no merit in this appeal. It cannot be said that judgment of learned Single Judge is erroneous in any manner so as to warrant interference in this intra Court Appeal.
4. Appeal lacks merits. Dismissed.
