Heard learned counsel for the petitioner, learned standing counsel for respondent nos. 1 and 2 and Sri Vijay Kumar Srivastava, learned counsel for respondent nos. 3 and 4.
Learned counsel for the petitioner submits that she has submitted application pursuant to Assistant Teachers Examination 2018 and obtained 72 marks out of 150. After declaration of result, she was allotted district Rampur, but respondent no. 4 has not issued appointment letter to the petitioner. Against that she has submitted representations dated 25.5.2019 and 12.7.2019 before respondent no. 4, but till date, neither appointment letter has been issued nor any order has been passed. Lastly, he submits that a suitable direction may be issued to respondent no. 4 to consider the representations dated 25.5.2019 and 12.7.2019 of the petitioner and issue appointment letter to the petitioner.
Sri Vijay Kumar Srivastava, learned counsel for the respondent nos. 3 and 4 submits that respondent no. 4 shall consider the representations dated 25.5.2019 and 12.7.2019 of the petitioner and pass reasoned order at the earliest in accordance with law.
Under such facts and circumstances, this petition is disposed of with direction to respondent no. 4 to consider the representations dated 25.5.2019 and 12.7.2019 of the petitioner and decide the same strictly in accordance with law maximum within a period of four weeks from the date of production of certified copy of the order. Petitioner is directed to annex the photocopy of representations dated 25.5.2019 and 12.7.2019 along with certified copy of the order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 4 to decide the representation of the petitioner after considering the relevant Rule as well as Government Orders occupying the field.
