Learned counsel for the petitioner is permitted to implead the District Basic Education Officer, Aligarh as respondent no.4 during the course of day.
Heard counsel for the petitioner, learned standing counsel for the respondent no.1, Sri Prem Prakash Yadav, learned counsel for the respondent nos. 2 & 3 and Sri Y.S. Bohra, learned counsel for the respondent no.4.
Learned counsel for the petitioner submitted that petitioner was initially appointed as Shiksha Mitra on 19.4.2006 at Primary School, Shahpur District, Aligarh. She has moved an application dated 30.8.2019 before the District Basic Education Officer, Aligarh-respondent no.4 for grant of maternity leave. He next submitted that in light of judgment of Anshu Rani Vs. State of U.P. And 2 others passed in Writ-A No.3486 of 2019 decided on 19.04.2019, she is entitled for six months maternity leave. He further requested that a suitable direction may be issued to respondent no.4 to consider the application of the petitioner dated 30.08.2019 and grant maternity leave in light of judgment of this Court given in the matter of Anshu Rani (Supra).
Sri Y.S. Bohra, learned counsel for the respondent no.4 submitted that application of the petitioner shall be considered and order shall be passed considering the relevant Rules as well as judgment of Anshu Rani (Supra).
Without entering into the merits of the case, the writ petition is disposed of with a direction to respondent no.4 to consider the application of petitioner dated 30.8.2019 in light of judgment of Anshu Rani (Supra) and other Government orders, if any, required and decide the same strictly in accordance with law maximum within three weeks from the date of production of certified copy of this order.
