Heard Sri Udai Chandani, learned counsel for the petitioner and Sri Ajal Krishna, learned counsel appearing for respondent nos. 3 and 4.
Present writ petition has been filed for issuance of mandamus commanding the respondent no.1-Debt Recovery Tribunal, Allahabad Bench, Allahabad Through its Registrar to decide the Securitization Application No. 38 of 2011, under Section 17 (1) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 within stipulated period.
It is submitted by learned counsel for the petitioner that the petitioner is an auction purchaser and the said application is pending since 2011, but till date the same has not been decided.
On the other hand, learned Standing Counsel submits that 25th February, 2021 is the next date fixed in the matter and he has no objection in case, suitable direction for deciding the said application be passed.
Considering the above, this petition stands disposed of with the direction to the respondent no.1-Debt Recovery Tribunal, Allahabad Bench, Allahabad Through its Registrar to decide the Securitization Application No. 38 of 2011, under Section 17 (1) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, as expeditiously as possible, preferably within a period of six months from the date of production of copy of this order.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
