The defendants in O.S.No.113 of 2011 on the file of the Court of the Additional Subordinate Judge, Kottayam are the appellants. The respondent is the plaintiff in the suit. The suit O.S. No.113 of 2011 was one for specific performance of an agreement for sale and the suit was decreed as prayed for, as per the decree and judgment impugned in this appeal.
2. In the course of the proceedings, the matter has been settled out of Court and a compromise Petition has been filed as I.A. No.2838 of 2014. We have perused the terms of settlement and we are satisfied that the terms of settlement are lawful.
3. In the circumstances, the judgment and decree impugned in this appeal are set aside and the suit O.S.No.113 of 2011 on the file of the Court of the Additional Subordinate Judge, Kottayam is dismissed. The respondent will be entitled to withdraw the amounts deposited by R.F.A.No.172 of 2013 2 him before the court below as directed in the impugned decree and judgment. A copy of the compromise petition shall be appended to this judgment.
