JUDGMENT / ORDER

Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the release of the petitioner on bail in the event of her arrest in connection with the Crime No. 80 of 2014 on the file of the P.S. Sadasivapet, Medak District, pending investigation and trial of the case.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri T. Damodar, Advocate for the Petitioners and of the Public Prosecutor on behalf of Respondent- State, the Court made the following
ORDER:-
“Heard both sides.
This petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner-accused No.3 for release in the event of her arrest in connection with crime No.80 of 2014 of Sadasivapet Police Station, Medak District, registered for an offence punishable under Sections 120B, 386, 406, 420, 423 and 506-II of Indian Penal Code.
The case came to be registered on the basis of the private complaint lodged by the de facto complainant. A perusal of the complaint shows that the dispute is civil in nature. A.1 has already been granted bail under section 439 Cr.P.C. and A.2 and A.4 are said to have been granted anticipatory bail. Petitioner herein is a woman aged about 38 years. She is said to be the permanent resident of Malkajgiri, Hyderabad.
Considering the above, this petition is allowed and the petitioner-A.3 is directed to surrender before the Judicial Magistrate of First Class (Special Mobile Court), Sanga Reddy, and on such surrender she shall be enlarged on bail on her executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for the likesum each to the satisfaction of the said Magistrate. Petitioner is further directed to co-operate with the investigation agency during enquiry, not to interfere with the investigation and appear before the investigation agency as and when required.”
