This application U/S 482 Cr.P.C.has been filed seeking quashing of the order dated 16.9.2019 passed by the Chief Judicial Magistrate, Allahabad as well as the entire proceedings of Case No. 2507 of 2019, arising out Case Crime No. 402 of 2018, under Sections 147, 149, 323, 504, 506, 342, 328 and 313 I.P.C., P.S. Kotwali, District Allahabad.
Heard learned counsel for the applicants, learned A.G.A. and perused the record.
At the very out-set, learned counsel for the applicants states that he does not want to press the prayer seeking the quashing of the order dated 16.9.2019 as well as the entire proceeding of the aforesaid case, hence the same may be dismissed as not pressed. Instead only submission made by the learned counsel for the applicants is that the applicants want to move discharge application in the court below and, therefore, for that purpose, liberty may be granted to them.
In view of the submissions made by the applicants' counsel, the prayer for quashing of the order dated 16.9.2019 as well as the entire proceedings of the case stands dismissed.
However, the applicants may avail legal remedy byway of moving an application before the court concerned if the law permits to do so.
With the aforesaid observation, this application is disposed off.
