Heard Sri Santosh Kumar Shukla, learned counsel for the petitioner. Learned Standing Counsel for the respondent State and Sri Pramod Kumar Singh, learned counsel for the respondent.
The principal prayer in the writ petition reads thus:
"1.Issue a writ, order or direction in the nature of mandamus directing the municipal Commissioner Nagar Nigam, Allahabad to submit the report, in pursuance of the letter, issued by District Magistrate, Allahabad dated 22.06.2016, in regard to application moved by the petitioner for free hold the plot no. 80-81, area 134.25 suare meter, situated at Lukerganj, Allahabad within specified period, stipulated by this Hon'ble Court."
Pursuant to a Government Policy dated 4 March 2014, petitioner moved an application before the District Magistrate, Allahabad and deposited the requisite fee i.e. 25% of the circle rate. It appears from the said application that the District Magistrate vide communication dated 22 June 2016 sought report from the fourth respondent, Municipal Commissioner, Nagar Nigam Allahabad which according to the petitioner has not yet been submitted.
Learned counsel appearing for the Nagar Nigam submits that the report pursuant to communication dated 22 June 2016 shall be submitted within a time frame, if not already submitted.
In regard thereto, the petition is being finally disposed of directing the fourth respondent, Municipal Commissioner, Nagar Nigam Allahabad to submit the report to the District Magistrate expeditiously preferably within eight weeks from the date of filing of certified copy of this order along with the copy of the writ petition and annexures thereto. The District Magistrate shall pass appropriate order on the application of the petitioner after receiving the report within the next eight weeks thereafter. It is clarified that the Court has not considered the claim and contention of the petitioner on merits.
