Heard learned counsel for the petitioners and Sri Shyam Krishna Gupta, learned counsel for respondent nos. 3 and 4 and learned Standing counsel for the State.
This Court on 18.11.2019 passed the following order:-
"Learned counsel for the petitioners submits that show cause notice dated 07.09.2019 has been issued against the petitioners on the ground that petitioners have obtained appointment on the basis of forged B.Ed. degree and they have been asked to submit their reply within 15 days. He submits that though, there is no order stopping the salary of petitioners but they are not being paid salary.
Sri S.K. Gupta, learned counsel for respondent no.3 prays for and is granted one week time to seek instructions in the matter and to apprise the Court as to why the salary of the petitioners has been stopped.
Put up on 28.11.2019 in the additional cause list."
On the basis of instructions, Sri Shyam Krishna Gupta, learned counsel for respondents submits that the salary of the petitioner has not been stopped.
The instructions are taken on record.
In view of the submission made by the learned counsel for the respondents, it seems that no cause of action survives in the instant writ petition to the extent of grievance of petitioner for non payment of salary.
A show-cause notice dated 07.09.2019, issued by the respondent authority to the petitioners is also challenged by them in the present writ petition. The petitioners may submit their reply on the said show-cause notice and the competent authority shall pass appropriate order, in accordance with law, after giving opportunity of hearing to both the parties, as expeditiously as possible.
With the aforesaid, the writ petition stands disposed of. Order Date :- 28.11.2019/S.K.
