Heard learned counsel for the petitioner; learned AGA for respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 27th July, 2019 registered as Case Crime No.272 of 2019, under Sections 498-A and 304-B IPC and Section 3/4 of Dowry Prohibition Act at Police Station Kotwali, District Budaun.
The allegations in the impugned first information report relate to a case of dowry death as the victim had died an unnatural death within seven years of her marriage and there are also allegation that she had been harassed in connection with demand of dowry. The petitioner is the mother-in-law of the deceased.
As the allegations disclose commission of cognizable offences, the prayer of the petitioner to quash the first information report is misconceived.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail.
