Heard learned counsel for the petitioner. Sri Abhishek Mishra, learned counsel for the third respondent and Sri Kuldeep Singh, learned counsel appearing for the first and second respondent.
Petitioner claims to have married the ex-employee, C.P. Gupta, who was working as Driver in Defense Department after the death of his wife namely, Ram Dulari Gupta. It is urged that Ram Dulari Gupta died on 23 November 2006 and the petitioner contracted marriage with C.P. Gupta on 2 August 2010. By means of the instant writ petition, petitioner primarily seeks the following relief:
"Issue a writ, order or direction in the nature of mandamus directing the respondent to pay the pensionary benefit as well as other emoluments to the petitioner being legally wedded wife of the petitioner and arrears if any is in balance."
Learned Standing Counsel submits that the second respondent shall consider and decide the claim of the petitioner expeditiously.
In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by the respective parties, it is provided that the second respondent, Principal Office, C.D.A. Pension Allahabad, shall consider and decide the claim/representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within three months from the date of filing of certified copy of this order along with the copy of the writ petition.
With the aforementioned observations/directions, the writ petition stands disposed of.
