JUDGMENT / ORDER

Mallikarjun Yadav, S/o late M. Narsing Yadav Petitioner/Accused No.2 AND The State of Telgangana, Through P.S. Jubilee Hills, Hyderabad, Rep. by its Public Prosecutor of the State of Telangana in the High Court of Judicature at Hyderabad for the State of Telangana and The State of Andhra Pradesh.

COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in the event of his arrest in Crime No. 484/2014, on the file of S.H.O. P.S. Jubilee Bills, Hyderabad.
The Court made the following Order:
“The petitioner is A-2. He seeks for grant of anticipatory bail. He allegedly committed offences under Sections 385, 354, 509, 427 and 448 IPC. Learned counsel for the petitioner submitted that there was delay in lodging FIR. Perhaps the delay of one day in a complaint, where the offence under Section 354 IPC is involved, cannot be treated as a delay. At any rate, A3 had already been enlarged on anticipatory bail. The remand report discloses that eight witnesses had already been examined. In view of the stage of the investigation and the nature of allegations against the petitioner, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Hence, this Petition is allowed. The petitioner/A2 shall surrender before the learned XVII Additional Chief Metropolitan Magistrate, at Nampally, Hyderabad, within two weeks from today. On such surrender, the learned XVII Additional Chief Metropolitan Magistrate, at Nampally, Hyderabad, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.”
