THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1004 of 2014 ORDER: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) The original file of Public Interest Litigation No.475 of 2013 has been produced before us. We have seen the order passed therein. By that order, we have directed the Collector concerned to make an enquiry into the complaint and after enquiry if it is found that the allegations made in the complaint are correct, then appropriate legal measures shall be taken forthwith without wasting any time. We have also directed to submit a compliance report of the order within a period of six weeks from the date of communication of the order. The order was received by the Collector and he sought for extension of time by writing a letter to the Registry. Therefore, his intention was not to violate the order of this Court.
Today, the report has been submitted and the same is taken on record.
In this contempt matter, we can only see that the order passed by this Court has been carried out, if not, whether such violation was willful or not. Here we notice that the compliance report is not submitted within the time. So, there has been technical breach of the order. However, we notice that the action taken by the officer is not willful breach.
We, therefore, close this Contempt Case giving liberty to the petitioner to take steps in accordance with law as may be advised.
Registry is directed to supply a copy of the report to the petitioner in accordance with law within a week from date. No costs.
