The matter is taken up through video conferencing.
Sri Ajay Kumar Giri and Sri Surendra Kumar, learned counsel appear on behalf of petitioner.
Learned Standing Counsel appears on behalf of respondent nos. 1 and 2.
Sri Yashwant Singh, learned counsel appears on behalf of respondent no.3.
The petitioner seeks quashment of recovery citation dated 20.02.2020 whereby an amount of Rs.522481.10 is directed to recover from the petitioner as arrears of land revenue being due in his account.
When the matter is taken up today it is stated on behalf of respondent no.3-Bank that in course of pendency of said recovery notice a settlement has been arrived at between the Bank and the petitioner where-under has deposited the entire loan amount as agreed between the parties that is amount of Rs.3,86,000/- has been deposited on 05.04.2021. In view whereof, it is stated that the present petition has rendered infructuous.
Taking into consideration the submissions made on behalf of respondent no.3-Bank that the petitioner has settled entire dues as per term of settlement on 05.04.2021 no cause of action survives for adjudication.
Consequently, petition stands disposed of having been rendered infructuous.
