This application has been filed by the appellant/applicant with the prayer that leave to appeal may be granted against the judgment and order dated 17.9.2016 passed by the Additional Sessions Judge, Anoopshahar, Bulandshahar acquitting the accused-respondent under section 304 I.P.C. in S.T. No. 724 of 2013, State Vs. Pramod Kumar, arising out of case crime no. 129 of 2013, P.S. Anoopshahar District Bulandshahar.
Heard learned A.G.A. for the State of U.P. and perused the record.
It is noteworthy that against the aforesaid impugned judgment and order of acquittal dated 17.9.2016, an appeal, being Government Appeal No. 6556 of 2016,preferred by the State has been dismissed today by this court, vide order dated 31.10.2018.
In view of the above, this application seeking leave to appeal is, rejected and, consequently, the present appeal also stands dismissed.
