Heard Shri Sarvesh Kumar Pandey, learned counsel for the petitioners and Shri Sanjay Kumar Singh, learned Standing Counsel for the respondents.
The petitioners are before this Court with request to issue direction to the respondents to decide their claim for their repatriation from District Armed Police to Provincial Armed Constabulary (PAC) 38th BN, PAC, Aligarh and to permit them to continue to work at 38th BN, PAC, Aligarh.
Learned counsel for the petitioners submits that the petitioners were working as Constables, 38th Bn., PAC, Aligarh. In pursuance of the Government order dated 28.5.2019 they applied for and were transferred from PAC to District Armed Police vide orders dated 23.8.2020, 28.8.2020, 25.10.2020 and 14.12.2020. It is alleged that the aforesaid transfer orders were not made in accordance with their choice. So far as the grievance of the petitioners is concerned, they have already filed representations (Annexure No.4 to the writ petition) before the respondents for redressal of their grievance, which are still pending. The petitioners have confined their prayer only to the relief that their representation may be considered by the appropriate authority.
Learned Additional Chief Standing Counsel very fairly states that in case the aforementioned representations are pending for consideration, the same will be considered and decided expeditiously.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending for consideration and without adverting on the merit of the case, the writ petition stands disposed of finally with the direction to the competent authority to decide the aforementioned representations of the petitioners strictly in accordance with law, as expeditiously as possible and preferably within six weeks from the date of production of a copy of this order before him.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
