ORDER:
This Writ Petition is filed for Mandamus to set aside proceedings, vide R.C.No.C/183/2014, dated 29.09.2014, of respondent No.3 and also proceedings, vide Rc.No.F4/1493/ 2014, dated 18.11.2014, of the Collector (Civil Supplies) Warangal. The petitioner sought for a consequential direction to respondent No.3 to revoke the suspension order in R.C.No.C/183/2014, dated 07.07.2014.
The petitioner is the permanent fair price shop dealer of Kothur, H/o Chinthapalli Village, Kuravi Mandal, Warangal District. On 04.02.2014, a show cause notice was issued by respondent No.3 to the petitioner to show cause why his fair price shop authorization should not be terminated for indulging in political activities and forcing the card holders to join a particular party. On 07.07.2014, the petitioner's authorization was suspended. Later on, respondent No.4 appeared to have sent a report, dated 24.09.2014, to respondent No.3, wherein he has given the petitioner a clean chit. Instead of completing the enquiry and passing an appropriate order, respondent No.3 has addressed letter on 29.09.2014 to the Collector (Civil Supplies), Warangal, seeking her guidance in taking a decision. The Collector (Civil Supplies), Warangal, has, in turn, replied to respondent No.3 on 18.11.2014, stating that the former is the competent authority to enquire into the matter and pass a final order after enquiry. Feeling aggrieved by non-completion of the enquiry and passing of a final order by respondent No.3, the petitioner filed this Writ Petition.
At the hearing, learned Government Pleader of Civil Supplies (Telangana State) submitted that as respondent No.4 has already submitted a report, respondent No.3 is bound to take a decision and that appropriate direction may be issued to him to complete the enquiry and pass a final order.
In the light of the above facts and the submission made by learned Government Pleader, the Writ Petition is disposed of with the direction to respondent No.3 to pass a final order in the light of the report, dated 24.09.2014, of respondent No.4 and communicate the same to the petitioner within two weeks from the date of receipt of a copy of this order.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.50178 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
