ORDER:
This petition is filed to withdraw O.P.No.1199 of 2013 from Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad and transfer the same to Family Court, Visakhapatnam or Vizianagaram.
Petitioner is wife. According to her affidavit, filed in support of the petition, after the marriage, she joined the respondent and due to harassing attitude of the respondent, she was forced to leave the matrimonial home and staying with her parents at Thagarapuvalasa, remote village in Visakhapatnam District. The respondent/husband filed O.P. before Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad for restitution of conjugal rights and it is difficult for her to travel 800 kilometers from her village to Ranga Reddy for defending the said OP and that she cannot meet the expenses for traveling and she has no relatives at Hyderabad and she has to stay in a hotel. Considering these aspects, she sought transfer of the subject OP from Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad to Family Court, Visakhapatnam or Vizianagaram.
Respondent, in spite of service of notice, neither appeared in person nor through any Advocate.
Heard the arguments.
Considering the reasons stated in the affidavit and also considering the convenience of the wife, O.P.No.1199 of 2013 is withdrawn from Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad and transferred to Family Court, Visakhapatnam for disposal in accordance with law.
The Transfer Miscellaneous Petition is accordingly allowed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
