Heard Sri Vibhor Shukla, learned Counsel for the petitioner and Sri S.P. Singh, learned AGA for the State/respondents no. 1 to 3.
With the consent of the learned Counsel for the petitioner and learned AGA, the writ petition is being disposed of finally at this stage, though no steps have been taken by the petitioner for service upon respondent no.4.
This writ petition has been filed by the petitioner, Malik Singh, seeking to quash the First Information Report registered as F.I.R. No. 0372 of 2017, under Sections 419, 420, 467, 468, 471, 504 I.P.C., Police Station Kotwali Dehat, District Hardoi.
Vide order dated 18.12.2020, a Co-ordinate Bench of this Court stayed the arrest of the petitioner till the next date of listing or till filing of the police report under Section 173 (2) of the Code of Criminal Procedure. However, the petitioner was directed to co-operate with the investigation.
Short counter affidavit filed today on behalf of the State is taken on record.
Learned AGA submitted that statement of the petitioner was recorded and only statements of two co-accused persons, namely, Shakti Singh and Shashank Singh are to be recorded in order to complete the investigation. He submits that the charge-sheet would be filed by the Investigating Officer immediately after completion of the investigation.
Considering the facts and circumstances of the case, the Superintendent of the Police, Hardoi is directed to ensure that the investigation shall be concluded and charge-sheet shall be filed before the competent Court within two weeks. The petitioner is also directed to co-operate with the investigation.
Till submission of the charge-sheet before the competent Court, the interim order dated 18.12.2020 shall remain in operation.
The writ petition stands disposed of, accordingly.
