JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Pursuant to the notice issued herein, the corpus, i.e. respondent No.5 Khevnaben, is produced and she has stated in presence of the petitioner as well as her parents that her life is in danger if she were forced to go with the petitioner. Therefore, she requested that she may be allowed to live with her parents and the parents are willing to take full care of the corpus. Learned counsel for the petitioner fairly conceded that in view of unwillingness of the corpus, he does not insist upon granting custody of Khevnaben whom he claims to have married. In these facts, the petition does not survive for any further orders and therefore, it is disposed and Notice is discharged, with the observation that the corpus Khevnaben may be allowed to go with her father, i.e. respondent No.4, and the petitioner has agreed not to take any coercive step for her custody.
